The overall purpose of patents is to promote the disclosure of innovations so that others may make improvements based on those new technologies, while at the same time rewarding those who came up with the invention. Software patents are not wrong entirely, in that it is still good to provide rewards to those who innovate. According the United States patent system, ideas are not patentable, while innovations are patentable. Software engineering blurs the line between ideas and innovation, in that software can be viewed as both an idea in the sense that it is a series of mathematical expressions, or it can be viewed as an innovation in that it can be delivered as an executable product. If patents are to be issued for software, a different system of laws governing software innovations needs to be established. The discrepancy on how to treat patents in software is illustrated by the opposing stances of the United States (who issues software patents) and the European Union (who does not issue software patents). History of Patents The main idea behind patents is to promote technological innovations. For there to be technological innovation for society as a whole, two things must happen. 1.1 Introduction I am writing this report as a requirement for my HNC Health Care course which will be submitted to Christine Hughes. In this report I will be comparing and contrasting two health care professions, the two health care professions I have chosen to compare is nursing and social work. The report will be highlighting the principles of healthcare, such as Education and Registration, (still to finish) 1.2 Nursing Education & Registration To train to be a qualified nurse you undertake either a pre-registration diploma or degree at university this is normally a three year programme. Degrees and diploma programmes comprise of 50% theory and 50% practice, with time split between the higher education institute. Nursing is organised into four branches – Adult, Children, Mental Health and Learning Disabilities. During the first year of nurse training you are introduced to all of the key areas as part of the Common Foundation Programme. In the second and third year you focus on a specific branch, which runs the course. Registered nurses and midwives are responsible for assessing the needs of individuals, planning and implementing their care, and evaluating the effectiveness. The Nursing and Midwifery Council (NMC) is the statutory regulatory body for nursing, midwifery and health visiting in the United Kingdom. All nurses working in the UK, including those trained abroad, need to be registered with the NMC in order to practice as a nurse in the UK, of that care. All qualified nurses, midwives and health visitors are required to be members of the NMC in order to practice. The course involves a combination of course work and a minimum of 200 days spent in practice settings providing the opportunity for lots of practical experience before you actually qualify. The social work qualification is suitable for social workers in all settings and sectors. As a student and once qualified you will need to register with the General Social Care Council (GSCC) which is responsible for regulating the workforce. Previous qualifications in social work including the diploma will continue to be recognised as valid social work qualifications. NMC register all nurses and midwives to ensure that they are properly qualified and competent to work in the UK. They set the standard of education; training and conduct that nurses and midwives will deliver high quality healthcare consistently throughout their careers. NMC also makes sure that nurses and midwives keep all their skills and knowledge up to date and to uphold the standards of their professional code. They also investigate allegations made against nurses and midwives who may not have followed the code. Every registered nurse, midwife or health visitor must renew their registration every three years. Post-registration education and practice (Prep) is set by the NMC which is designed to help nurses and midwifes provide a high standard of practice and care. There are legal requirements set which must be met in order for there registration to be renewed. 2.2 General Social Care Council The General Social Care Council (GSCC) sets standards of conduct for social care employers and workers, this regulates the social care workforce including regulating social work their training and education. The GSCC is responsible for codes of practice for employers and employees in the care sector. Social Care Register is a register of qualified social workers, the registration will ensure that those working in social care meet rigorous registration requirements and will hold them to account for their conduct by codes of practice. Registered social workers are also required to complete post-registration training and learning activities before renewing their registration every three years. Post-registration training and learning requirements that all registered social workers must meet are every social worker registered with the GSCC shall, within the period of registration, complete either 90 hours or 15 days of study, training, courses, seminars, reading, teaching or other activities which could reasonably be expected to advance the social worker’s professional development. To keep a record of post-registration training and learning undertaken, and failure to meet these conditions may be considered misconduct. Continuing Professional Development in Nursing All registered nurses and midwives are required to take part in continuing professional development (CPD) in order to maintain their professional registration. This is part of the post-registration education and practice (PREP) requirements, set by the Nursing and Midwifery Council NMC. There are two types of PREP, 1. Practice standards and Continuing professional development standards. CPD is fundamental to the development of all health care practitioners, as it is important that nurses keep there knowledge and skills up-to date, to improve standards in the practice and to gain more qualifications. To meet the CPD standards nurses must undertake at least 35 hours of learning activity relevant to their practice every three years, to maintain a personal professional profile of their learning activity and to comply with any requests to audit how they have met these requirements. Nurses and midwives who do not comply with the Prep requirements will cause their registration to lapse and can no longer work as a registered nurse or midwife. These requirements must be met every three years, and are declared at the point that registration is renewed. 3.1 Clinical Governance Clinical governance is the framework through which the NHS is accountable for the continuing improvement of quality of professional standards whilst still safeguarding high standards of care, thereby creating an environment which aims for clinical excellence. It is to ensure that high quality and professional standards are being maintained, and that health professionals are competent to deliver care safely with the right training and skills. This protects the patients from risks and mistakes allowing them to have confidence and faith in their care providers. Clinical governance also ensures that practitioners are accountable for the quality of patient care they provide meaning that they are more likely to question their practice and seek to make it of more benefit to the patient’s health. If it is found that those standards are not being met or they have got complaints from individuals about there delivery of care, there will be someone answerable for the failures to maintain standards. Nurses are responsible for their own competence and if they carry out treatments or procedures then they will be deeming themselves to do so.

Rene Descartes essays Rene Descartes was one of the most important and influential thinkers in human history. Both modern mathematics and modern philosophy began with the work of Rene Descartes. He is often referred to as the father of modern philosophy. His invention of coordinate geometry paved the way for advances in mathematics. Descartes also offered a modern theory for the origin of the solar system of the Earth. Rene Descartes was born on March 31 1596, at La Haye in the Touraine region of France. He was educated at the Jesuit college of La Fleche where he admired his teachers but later he said that he found little of the substance in the course of instruction and that only mathematics had given him any certain knowledge. After receiving a law degree in 1616 at the University of Poitiers, he became a volunteer in the Dutch and then the Bavarian army and traveled throughout Europe. He resumed his studies of math and science when his duties permitted. He was unsatisfied with the haphazard methods of science and then in use, he began to doubt all but mathematical knowledge. Descartes method of systematic doubt had a great impact on the resulting development of philosophy. In 1619, he arrived at the conclusion that the universe has a mathematically logical structure and that a single method of reasoning could apply to all natural sciences, providing a unified body of knowledge. This theory was developed on November 10, 1619 in Ulm, Germany. From 1626 to 1629 Descartes lived mostly in Paris. But he thought the pressures of social life kept him from his work, so he then moved to Holland in search of seclusion. He developed his first major work, Rules for the Direction of the Mind, at his new, more private home in Holland. Bill Peet, Author and Illustrator of Childrens Books As well known as Bill Peet became for his childrens books, Peet was even more well known for his work at Walt Disney Studios as an animator and writer for major Disney movies. Its not often that a person achieves national recognition in two careers but such was the case with Bill Peet who truly was a man of many talents. Early Life of Bill Peet Bill Peet was born William Bartlett Peed (later changing his last name to Peet)  on January 29, 1915, in rural Indiana. He grew up in Indianapolis and from childhood on was always drawing. In fact, Peet often got in trouble for doodling in school, but one teacher encouraged him, and his interest in art continued. He received his art education through an art scholarship to John Herron Art Institute, which is now a part of Indiana University. Career at Disney In 1937, when he was 22 years old, Bill Peet began working for Walt Disney Studios and shortly thereafter married Margaret Brunst. Despite clashes with Walt Disney, Peet stayed at  Walt Disney Studios for 27 years. While he started as an animator, Peet quickly became known for his ability to develop a story, having honed his storytelling abilities telling nightly stories to his two sons. Bill Peet worked on such animated classics as Fantasia, Song of the South, Cinderella, The Jungle Book. 101 Dalmatians, The Sword in the Stone and other Disney movies. While still working at Disney, Peet began writing childrens books. His first book was published in 1959. Unhappy with the way Walt Disney treated his employees, Peet finally left Disney Studios in 1964 to become a full-time writer of childrens books. Childrens Books by Bill Peet Bill Peets illustrations were at the heart of his stories. Even his autobiography for children is illustrated. Peets love for animals and his sense of the ridiculous, coupled with a concern for the environment and for the feelings of others, make his books effective on several levels: as enjoyable stories and as gentle lessons on caring for the earth and getting along with one another. His clever illustrations, in pen and ink and colored pencil, often feature funny looking imaginary animals, like the wumps, the kweeks and the fandangos. Many of Peets 35 books are still available at public libraries and bookstores. A number of his books are award winners. His own story, Bill Peet: An Autobiography, was designated a Caldecott Honor book in 1990 in recognition of the quality of Peets illustrations. While most of Peets books are picture books, Capyboppy is designed for intermediate readers and is 62 pages long. This entertaining book is the true story of the capybara who lived with Bill and Margaret Peet and their children. We discovered the book, which has black and white drawings on every page, just at the time our local zoo acquired a capybarra and that gave it a good deal of extra meaning for us. Other childrens books by Bill Peet include The Wump World, Cyrus the Unsinkable Sea Serpent, The Wingdingdilly, Chester, The Worldly Pig, The Caboose Who Got Loose, How Droofus the Dragon Lost His Head and his last book, Cock-a-Doodle Dudley. Bill Peet died on May 11, 2002, at home in Studio City, California at the age of 87. Conquerors or Jinas Essay Jainism originated in ancient East India by the birth and ultimate liberation of twenty four conquerors or Jinas. People of the Jain faith believe that Jinas are human beings who become divine by subduing their sensual desires and overcoming karma, which is the accumulation of good and bad deeds. Good deeds allow living beings to be reincarnated into superior forms, while bad deeds force them to accept inferior forms after death (â€Å"Jainism†). The Jains believe that the first Jina or conqueror was a giant living on earth 8. 4 million years ago. The last Jina was Mahavira or The Great Hero, born in 550 BC. Mahavira is known as the founder of Jainism, seeing that he was able to attract a large number of followers to his faith (â€Å"Jain Dharma†). Like Siddharta Buddha, Mahavira had belonged to the warrior caste and â€Å"renounced the world† at the age of thirty (â€Å"History of Jainism†). Also like the Buddha, Mahavira had sought spiritual reality in the solitude of asceticism. Ultimately he had found enlightenment, although it had taken him thirteen long years to get there. He had converted eleven Brahmans to his faith soon after. By the time of his death, he had founded a community of ascetics with fourteen thousand monks and thirty six thousand nuns. Mahavira is further known to have starved himself to death – a practice referred to as salekhana (â€Å"History of Jainism†). According to the Jains, Mahavira is one of the fortunate ones, as he has â€Å"conquered love and hate, pleasure and pain, attachment and aversion, and has thereby freed ‘his’ soul from the karmas obscuring knowledge, perception, truth, and ability (â€Å"Jain Dharma†). † The first and foremost principle of living taught by Jainism is called Ahimsa or non-violence toward all living beings. Thus, the followers of Jainism have never encountered a problem of violence in their history. The only issue that the people of the Jain faith have had to confront is disunity. Two hundred years after the attainment of nirvana on the part of Mahavira, the Jain faith was divided into two sects: the Digambar and the Svetambar. Both sects hold different views or beliefs about a number of issues. For example, Digambar monks of the Jain faith do not wear anything because of their belief that clothes serve as reminders of the world. Svetambar monks, on the other hand, are known to wear seamless clothes that are usually colored white. Moreover, the Digambars are of the opinion that women are unable to attain liberation while they are living as women on earth. Svetambars, on the contrary, believe that women may indeed achieve liberation seeing that one of the Jinas was a woman. Likewise, the Digambars and Svetambars have varied views about the prayers that are traditionally recited by the Jains (â€Å"Jainism†). The Jains do not believe in a creator of the universe. According to them, the world is without beginning or end. Furthermore, there is no single god of the universe (Sivananda). The following is a prayer of the Jains describing their unique concept of divinity, following by a brief introduction of the same: I bow to the Arahants, the perfected human beings, Godmen. I bow to the Siddhas, liberated bodiless souls, God. I bow to the Acharyas, the masters and heads of congregations. I bow to the Upadhyayas, the spiritual teachers. I bow to the spiritual practitioners in the universe, Sadhus. This fivefold obeisance mantra destroys all sins and obstacles, and of all auspicious repetitions, is the first and foremost (Welcome to Jainism. org). Jains believe that all living beings are the same essential soul, but those human beings that perfect or liberate themselves are turned into gods. These souls – part of the single soul of all living beings, albeit separate – are worshipped by the Jains. Furthermore, these souls are the only ones that do not have to deal with karma any longer. They have achieved salvation through enlightenment, abandonment of worldly attachments, and asceticism. By controlling their selfish desires, they have followed their spiritual teachers to the core. For them, Jainism is the only true religion. Additionally, by attaining the divine status, they have become omnipotent and omnipresent (Sivananda). Before becoming gods, the liberated souls were able to achieve death at will. On the other hand are souls that are so attached to life that they do not wish to end their lives on earth. Such souls die nevertheless. Their death is Akama Marana, the death of helplessness, leading the soul to return to earth in an inferior form (â€Å"Death in Jainism†). There are seventeen kinds of deaths in the Jain faith: â€Å"Avici-marana; Avadhimarana; Atyantika-marana; Vasarta-marana; Valana-marana; Antahsalya-marana; Tadhava-marana; Akama marana; Pandita-marana; Balpandita-marana; Chadmastha-marana; Kevali-marana; Vaihayasa-marana; Guddhapristha-marana; Bhaktapratyakhyana-marana; Inginta-marana; and Padopagamana-marana (â€Å"Death in Jainism†). † Unsurprisingly, all of these separate types of deaths lead to a different kind of life after death. Jains are believers in the reincarnation of all living beings. Thus, the soul that dies the Pandita-marana death is said to have left the earth in peace and with satisfaction (â€Å"Death in Jainism†). The best kind of death is, of course, the very last one, that is, the end that leads to ultimate liberation from the process of rebirth (â€Å"Jainism†). Besides Ahimsa or non-violence, which forbids actions that cause verbal, emotional or physical harm to living beings; the principles of human behavior that the Jains must adhere to include the principle of Satya or the command to speak the truth and avoid falsehood; Asteya, or the command not to steal; Brahmacharya, or the principle demanding all Jains to remain monogamous in their sexual relationships; and Aparigraha, which is the principle of detaching oneself from the world by a reduction of worldly desires and abstinence from hoarding of material wealth (â€Å"Jain Dharma†). The Jains do not convert people to their faith. Hence, anybody who is willing to follow the faith of Jainism must believe in these moral principles and follow them without compulsion (â€Å"Jainism†). Jains additionally believe that every living being has the potential to attain ultimate liberation from the cycle of rebirth. The perfect and liberated souls serve as models on the path of attaining liberation. However, all living beings are responsible for their individual good or bad actions (â€Å"Jainism†). In order to attain ultimate salvation, souls must also believe in the triple jewels, that is, â€Å"[r]ight faith, right knowledge and right conduct (Sivananda). † Right faith constitutes belief in the perfect and liberated souls as real gods, the Jaina Sastras (written by spiritual teachers) as the scriptures of the Jain faith, and the saints of Jainism as the real teachers. Right knowledge provides the follower of Jainism with an eye of certainty that sheds all doubts. Right conduct, of course, constitutes the five moral principles that all Jains must adhere to, including Ahimsa, which compels all Jains to live as vegetarians (Sivananda). The assets to sales ratio indicates that Calaveras somewhat efficient in managing its assets in the relation the revenue generated. The higher the number the less investment is needed in order to generate revenue. Calaveras falls somewhere in between the upper and median quartile. But instead of going through this humiliation, he made the decision to commit suicide. He died in 68 A.
